Terms of Service

These terms are the agreement between you and Beacon Marketing Systems LLC ("Beacon," "we," "us"), a Wyoming limited liability company. By using our website, forms, free booth sign offer or services, you agree to them. We have kept them short and in plain English.

1. What we do

Beacon provides marketing services for farmers-market vendors, makers and small local businesses. This can include a free custom booth sign, sign-up pages (QR code and similar) so your customers can join your list, email and text messaging set-up, message drafting and sending, and basic reporting. What is included in a paid service is what we agree with you in writing (email is fine) before we start.

2. The free booth sign

The free custom booth sign is free. There is no obligation to buy anything, now or later. We will use the information you give us to design it, and we may follow up to see if you would like our other services. You can say no.

3. Paid services: month to month, cancel anytime

  • Paid services are month to month. There is no long-term contract.
  • You can cancel anytime by emailing [email protected]. Cancellation stops future charges; you keep the service through the end of the month you have already paid for.
  • Prices and what is included are agreed with you before you are charged.

4. You keep your customer list and domain, no matter what

Your customer list is yours. Your domain name is yours. That stays true if you cancel, if you stop paying, or for any other reason. When you ask, we will give you an export of your customer list, and help move your domain to you.

We collect your customers' information only on your behalf, as your service provider. We do not sell it or use it for Beacon's own marketing. See our Privacy Policy.

5. Your responsibilities

  • Give us accurate information, and let us know when it changes.
  • Only upload logos, photos and other material that you own or have permission to use. You let us use them to make your sign and provide our services.
  • Follow the law when you contact your own customers, including email and texting rules (for example, getting permission before texting, honoring unsubscribe and STOP requests, and not sending misleading messages).
  • Approve messages before they go out in your name, and tell us if anything is wrong.

6. Text message (SMS) terms

What you will receive: Account and service messages about your free booth sign and our services, such as design and delivery updates, appointment reminders, account notices, and replies to your questions.

  • How you opt in: You opt in by providing your mobile number and checking the text-message consent box on one of our forms, or in the chat widget on our website. Agreeing to receive texts is not a condition of purchase or of getting your free booth sign.
  • Frequency: Message frequency varies.
  • Cost: Message and data rates may apply.
  • Opt out: Reply STOP at any time to stop receiving texts. You will get one message confirming you have been unsubscribed.
  • Help: Reply HELP for help, or contact us at (947) 300-7052 or [email protected].
  • Carriers: Carriers are not liable for delayed or undelivered messages.
  • Privacy: We do not share your mobile information with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.

7. No guaranteed results

We work hard to help you reach and keep customers, but we cannot promise any specific number of sales, sign-ups, customers or income. Results depend on many things outside our control, like your products, your market, weather and foot traffic.

8. Limits on our liability

Our services are provided "as is." To the fullest extent the law allows:

  • We are not responsible for indirect losses, such as lost profits, lost sales or lost data.
  • We are not responsible for outages or problems caused by the outside services we rely on (such as HighLevel, Google, Cloudflare or phone carriers).
  • Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim. For the free booth sign, that amount is zero.

Some places do not allow some of these limits, so they may not all apply to you.

9. Governing law

These terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules.

10. Changes to these terms

We may update these terms from time to time. We will post the new version here and change the effective date at the top. If a change is significant, we will take reasonable steps to let you know. Continuing to use our services after a change means you accept the updated terms.
